Answered by Shaykh Abu Hamza Hassan bin Muhammed Bā Shu'ayb -may Allah preserve him-


📝🔹Question: 


Does the sadaqah on every joint suffice for the person who prays the Dhuhā prayer while sitting, being that the one who prays the voluntary prayer whilst sitting (with the capability of standing) gets half the reward of the one standing.


Or is it upon him to pray four units while sitting?


📩🔸Answer:


Yes it suffices and Allāh knows best, because it is applicable to him that he prayed two rak'ah of Dhuhā.

📚Chapter of the nullifiers of the Wudhu


📝The ruling of the broth:


What's well known from the Madhab of the Hanaabilah is that it doesn't nullify the Wudhu, because it's not eating meat. 


And an angle in the Madhab is that it's a nullifier, due to the presence of food in the broth, similar to cooking pig meat, is it permissible for us to drink its broth? The answer: No. 


Similarly the broth of camel meat takes the ruling of camel meat in it nullifying the Wudhu. 


Ibn 'Utheymeen, may Allah have mercy upon him, said:


This is a very strong reasoning, so it's safer to perform Wudhu.

Ibn Qudamah, may Allah have mercy upon him, said:


Besides meat of the parts of the camel, its liver, its spleen, its hump, its fat, its broth, its stomach, intestines, there are two positions in this:


The first:


That it doesn't nullify, because the text doesn't apply to it. 


The second:


That it nullifies, because it's part of the camel, and when meat is used regarding animals what's intended with this is all of it, because it's the majority of it, for this reason when Allah, the Most High, forbade the flesh of the pig, the prohibition is regarding all of it, similarly here. 


End of speech from Al-Mughni (1/141).


Ibn 'Utheymeen, may Allah have mercy upon him, said:


There's no single animal in the legislation of Muhammad ﷺ, that has different rulings regarding its body parts, Halal and Haram, pure and impure, negation and affirmation. 


If this was the case then the different parts of the camel are all the same.

📝Eating camel meat:


Regarding it is the Hadith of Jabir bin Samurah, that a man asked the Messenger of Allah ﷺ:


Do I perform Wudhu for eating sheep/goat meat? 


He said: 


(إِنْ شِئْتَ فَتَوَضَّأْ، وَإِنْ شِئْتَ فَلَا تَوَضَّأْ)

"If you wish then perform Wudhu and if you wish don't perform Wudhu".


Then he said:


Do I perform Wudhu for eating camel meat? 


He said:


(نَعَمْ فَتَوَضَّأْ مِنْ لُحُومِ الْإِبِلِ)

"Yes perform Wudhu for eating camel meat".


Then he said:


Can I pray where camels are rest? 


He said:


(لَا)

"No".


Reported by Muslim (360).


And the Hadith of Baraa bin 'Aazib, he said:


The Messenger of Allah ﷺ was asked regarding making Wudhu due to camel meat, then he said:


(تَوَضَّئُوا مِنْهَا)

"You perform Wudhu for it".


And he was asked regarding sheep/goat meat:


(لَا تَوَضَّئُوا مِنْهَا)

"You don't perform Wudhu for it".


And he was asked about the prayer where camels are rest, and then he said:


 (لَا تُصَلُّوا فِي مَبَارِكِ الْإِبِلِ؛ فَإِنَّهَا مِنْ الشَّيَاطِينِ)

"Don't pray where camels rest because they have the characteristics of the Shayateen.


And he asked regarding the prayer in the areas for sheep/goats, and then he said:


(صَلُّوا فِيهَا؛ فَإِنَّهَا بَرَكَةٌ)

"Pray there, because it is a blessing".


These Hadiths are an evidence for those that say that eating camel meat nullifies the Wudhu. 


It's the Madhab of:


➖Ahmed 

➖Ishaaq

➖Abu Thawr

➖Ibnl Mundhir

➖Ibn Hazm

➖Bayhaqi narrated to be from all the people of Hadith entirely. 


Bayhaqi said:


Some of our companions relayed from Shaafi'i that he said:


If the Hadith regarding camel meat is authentic then I take it as a position. 


Bayhaqi said:


There are two authentic Hadiths regarding it, the Hadith of Jaabir bin Samurah, and the Hadith of Baraa. 


At-Talkhees (1/154).


Ibn Khuzaimah said:


I haven't seen a differing between the scholars of the people of Hadith that this narration is authentic from the angle of it being relayed.

Nawawi said:


This Madhab has the strongest proof even though the Majority are upon its contrary.

The proof for the majority of the scholars of fiqh is the Hadith of Jaabir bin 'Abdullah, he said:


The last of the two affairs from the Messenger of Allah ﷺ is not making Wudhu for that which was cooked on fire. 


Reported by Abu Daud (192), Nasaa'i (185), declared Sahih by Albaani. 


Nawawi, said:


But this Hadith is general and the Hadith due to camel meat is specific, and the specific is preceded over the general, and Allah knows best.

📝The other Madhabs in the subject matter of sleep:


Sa'eed bin Al-Musayyib and Al-Hassan Al-Basri said:


If sleep crosses the heart of one of you then perform Wudhu. 


'Ataa bin Abi Rabaah said:

If sleep overtakes you then perform Wudhu, sitting or lying down. 


'Ataa, Tawuus, and Mujaahid said:

Whoever sleeps while in Rukuu', or in prostration, then let them perform Wudhu. 


Ishaaq and Al-Qaasim bin Salaam said:

Whenever one was to sleep until it overtook their minds they're to perform Wudhu. 


Az-Zuhri, Rabee'ah and Maalik:

If one slept a little it doesn't nullify their Wudhu, if it went further then Wudhu is performed. 


Al-Awzaa'i said:

If the sleep becomes heavy while sitting Wudhu is performed, as for those whose sleep is illusive, sleeping and waking, then there is no Wudhu upon them. 


Ahmed bin Hanbal said:

If the sleep for those sleeping while seated becomes lengthy then Wudhu is performed. 


Al-Hakam, Hamaad and Sufyaan Ath-Thawri said:

It's not obligatory upon the sleeping to perform Wudhu up until they lie on their side. 


The people of Intellect based opinions (Ra'yi) said:

If one was standing or in Rukuu' or prostrating or sitting, then this doesn't nullify the Wudhu, as for when sleeping lying down or leaning, then it nullifies the Wudhu. 


Abu Yusuf said:

It's like that except for the one prostrating in the prayer, he claims that even when intentionally sleeping while praying that Wudhu is obligatory to be made, and the prayer is invalid, and if sleep was to overtake them then there is no Wudhu upon them. 


Ibn Al-Mubarak said:

If a man was to sleep while prostrating in the prayer then there is no Wudhu upon him, and if one was to sleep while prostrating outside the prayer then it's upon them to perform Wudhu, if they intentionally slept during prostrating in the prayer then it's upon them to perform Wudhu. 


Shaafi'i said:

Regardless for the one thats on a boat or a camel or a donkey, and the lifted off the ground, whenever they were to descend, and snored or slept standing, or in Rukuu', or prostrating, or lying down, then Wudhu is to made, because the one that's sleeping while seated is flat on the ground and it's the case that nothing comes out from them except that they will notice it. 


Abu Thawr said:

The one that is sleeping while seated doesn't make Wudhu, and the one sleeping while lying down makes Wudhu.

If I hear the call to prayer of Fajr then go back to sleep without getting up to pray until after the sun has risen, would I be sinning?.
And what is the ruling concerning my prayer?.

If you was negligent and careless in this regard you would be sinful.
